Agreement to Terms

By accessing or using the services provided by MediaMD.com ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use our services.

Services

MediaMD.com is the growth engine for the practices patients choose, helping practices be found, trusted, and never left. Our services are: a Custom Patient App, and AI era Search Visibility, which covers Answer Engine Optimization (AEO), search engine optimization (SEO), and GEO. These are offered in two plans, Growth and Enterprise, both of which include the full app.

Client Responsibilities

As a client, you agree to:

• Provide accurate and complete information
• Maintain the confidentiality of your account credentials
• Comply with all applicable laws and regulations
• Pay all fees associated with your use of our services
• Not use our services for any unlawful purpose

Intellectual Property

Clients own their patient data, content, brand assets, and accounts outright, and can export them at any time. The custom patient app is licensed to the client and maintained by MediaMD for the duration of the engagement; MediaMD retains ownership of the app's underlying codebase, along with all proprietary tools, frameworks, and methodologies used in delivering services.

Payment Terms

Payment terms will be specified in individual service agreements. Unless otherwise stated, invoices are due within 30 days of receipt. Late payments may be subject to interest charges and suspension of services.

Limitation of Liability

To the maximum extent permitted by law, MediaMD.com shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services. Our total liability shall not exceed the amounts paid by you for services in the twelve months preceding the claim.

Termination

Either party may terminate services with 30 days written notice. Upon termination, clients retain their patient data, content, brand assets, and accounts, and may export them at any time; the client's license to the custom patient app ends when the engagement ends. Outstanding fees must be paid within 30 days of termination.
